Eligibility: The #CNCPTSfitbattle Sweepstakes (“Promotion”) is open only to those who are, as of the date of entry, legal residents of the United States and are at least thirteen (13) years of age (those seventeen (17) years and younger (a “Minor”) must have his or her parent’s or legal guardian’s permission before participating in the Promotion) (hereafter “Entrant”). Employees, officers, directors, representatives and agents of Concepts International LLC (“Sponsor”) and its parent companies, subsidiaries, and affiliates (collectively, with Sponsor, “Released Parties”), and their immediate family members (regardless of where they reside) and those living in the same household of each, are not eligible to participate or win a prize. Void where prohibited or restricted by law. Entry submission constitutes your unconditional acceptance to these Official Rules. Odds of winning depend on the number of eligible entries received.
How to Enter: The Promotion beings on May 27, 2020 at 10:00AM Eastern Time (“ET”) and ends July 16, 2020 at 11:59PM ET (the “Promotion Period”). During the Promotion Period, you may participate in the Promotion as follows (“Entry(ies)”):
Entry Round:
On or about July 7, 2020, up to sixteen (16) Entries will be randomly selected to advance to the Insta Stories Battle Round, as defined below, (each, a “Semi-Finalist(s)”).
Insta Stories Battle Round:
Instagram Stories Round One:
Up to eight (8) Semi-Finalists from Instagram Stories Round One will move onto Instagram Stories Round Two (as defined below).
Instagram Stories Round Two:
Up to four (4) Semi-Finalists from Instagram Stories Round Two will move onto Instagram Stories Round Three (as defined below).
Instagram Stories Round Three:
The final two (2) Semi-Finalists from Instagram Stories Round Three will move onto the Final Round (as defined below).
Final Round:
This Promotion is in no way sponsored, endorsed, or administered by, or in association with, Facebook, Twitter or Instagram. Entries must comply with applicable social media platform’s terms & conditions.
Privacy: Entries are treated pursuant to Sponsor’s Privacy Policy: https://cncpts.com/pages/privacy-policy and Terms of Service: https://cncpts.com/pages/terms-of-service.
Conditions: You may enter more than once during the Promotion Period but each Entry MUST be a unique and different submission to be eligible. Multiple Entries will increase your chance of winning. Incomplete Entries or Entries submitted by Entrants who do not meet the eligibility requirements will be void. Each Entry must be manually entered by the individual Entrant; use of automated technology or similar devices are prohibited. All Entries become the sole property of the Sponsor and will not be acknowledged or returned.
By participating, each Entrant, Semi-Finalist, and Winner unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, illegible, inaccurate or undelivered entries; or for or any other mechanical, technical or human error of any type whatsoever. Sponsor reserves the right, in its sole discretion, to void any Entries or Entrants and disqualify such Entrants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion and/or who are in violation of these Official Rules.
Selection & Notification of Semi-Finalists and Winner: Semi-Finalists will be selected at a reasonable time after the Entry Round of the Promotion in a random drawing from all eligible Entries received by Sponsor. Sponsor will announce the Semi-Finalists on Sponsor’s Instagram Stories to notify them that they are a Semi-Finalist and are advancing to the Insta Stories Battle Round of the Promotion. Sponsor will direct message the Winner via Instagram and provide contact information for Prize (as defined below) fulfillment. Winner must then contact Sponsor using the provided contact instructions within three (3) days of notification.
Semi-Finalists and Winner, or the parent or legal guardian of any Entrant who is a Minor, are subject to eligibility verification and compliance with these Official Rules and each Winner may be required to execute and return an Affidavit of Eligibility, which includes releases of liability and publicity, within two (2) days of issuance of notification. Winner may be required to provide a valid, government-issued form of identification that matches the name under which the Winner entered. If a dispute arises over entitlement to a prize, the Winner is the person to whom the applicable social media account is assigned. Noncompliance with the foregoing or with these Official Rules, or any notification not being successful or being returned as non-deliverable, may result in disqualification of the Semi-Finalist and Winner and, at Sponsor’s discretion, an alternate Semi-Finalist or Winner will be selected. Accepting the Prize constitutes permission for Sponsor to use Semi-Finalist’s and Winner’s Entry, name, likeness and other biographical information. Winners have the right to disclaim the Prize and the Semi-Finalist with the next highest votes may be randomly selected, in Sponsor’s sole discretion.
Prize(s): Sponsor will award one (1) prize to the Winner. Prize will include: i) Concepts branded apparel valued at approximately $100 (apparel to be selected by Sponsor based on available styles and sizes), and ii) a guaranteed opportunity to purchase, at Winner’s sole cost and expense, a product exclusively offered by Sponsor (“Exclusive Product”), (collectively, the “Prize”). The Exclusive Product must be selected and purchased within six (6) months of the conclusion of the Promotion Period. Approximate retail value (“ARV”) of Prize is $100.00. Total ARV of all Prizes to be awarded in this Promotion is $100.00. Prize Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the Prize they receive. No cash redemption or Prize substitution allowed, except by the Sponsor, who reserves the right in its sole discretion to substitute cash value or another prize it believes is of equal or greater value. Prize is non-transferable and will be awarded. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Miscellaneous: The Released Parties shall have no liability and will be held harmless by Entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Promotion (or portion thereof) for any reason, SPONSOR RESERVES THE RIGHT TO DISQUALIFY ANY INDIVIDUAL THAT ATTEMPTS TO UNDERMINE THE LEGITATE OPERATION OF THIS PROMOTION AND RESERVES ALL RIGHTS AND REMEDIES PERMITTED BY LAW.
Arbitration & Choice of Law: As a condition of participating in this Promotion, participant agrees that any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the Streamlined Rules of JAMS and held in Boston, Massachusetts. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the Massachusetts. - Post a picture of your best “fitpic” on your Instagram account, tag @cncpts, and use the hashtag #CNCPTSfitbattle to enter the Promotion (“Entry Round”).
On or about July 7, 2020, up to sixteen (16) Entries will be randomly selected to advance to the Insta Stories Battle Round, as defined below, (each, a “Semi-Finalist(s)”).
Insta Stories Battle Round:
Instagram Stories Round One:
- On or about July 8, 2020, Sponsor will post two (2) Semi-Finalist’s Entries on Sponsor’s Instagram Story for a period of twenty-four (24) hours (each, an “Instagram Stories Period”) and ask followers to vote on their favorite Entry contained in the Instagram Story (“Insta Story Battle(s)”).
- There will be up to eight (8) Insta Story Battles in Instagram stories round one (“Instagram Stories Round One”).
Up to eight (8) Semi-Finalists from Instagram Stories Round One will move onto Instagram Stories Round Two (as defined below).
Instagram Stories Round Two:
- On or about July 10, 2020, Sponsor will post up to four (4) Insta Story Battles to narrow the Semi-Finalists down to up to four (4) Semi-Finalists (“Instagram Stories Round Two”).
Up to four (4) Semi-Finalists from Instagram Stories Round Two will move onto Instagram Stories Round Three (as defined below).
Instagram Stories Round Three:
- On or about July 12, 2020, Sponsor will post up to two (2) Insta Stories Battles to narrow the Semi-Finalists down to two (2) Semi-Finalists (“Instagram Stories Round Three”).
The final two (2) Semi-Finalists from Instagram Stories Round Three will move onto the Final Round (as defined below).
Final Round:
- On or about July 14, 2020, Sponsor will post the final Insta Story Battle (“Final Round”, and collectively with Instagram Stories Rounds One, Two, and Three (the “Insta Story Battle Round”)) and the Semi-Finalist with the most votes at the end of the Final Round will be declared the winner (“Winner”).
